摘要:
化解地方政府隐性债务不仅是政府基于财政法角度对财政政策工具的运用,更是基于经济法角度对经济和社会问题的综合治理。既有的化债措施以识别地方政府隐性债务为前提,以发行政府专项债券置换地方隐性债务为核心,具有直接性和规模性的效果,但在法律依据、识别和置换的具体规则、绩效评估等方面仍有待完善。对此,应择机制定及完善化债相关财政政策工具的法律依据,在债务识别和置换层面推进法治化和市场化,加强对化债措施的绩效评估,并以政府投融资体制改革为核心完善相关配套措施。

Abstract:
Resolving the implicit debts of local governments is not only the government’s use of fiscal policy tools from the perspective of fiscal law but also a comprehensive governance of economic and social issues from the perspective of economic law. The existing measures for resolving debts, which are based on identifying local governments’ implicit debts, with the issuance of government special securities to replace local governments’ implicit debts as the core, have direct and large-scale effects. However, there is still room for improvements in terms of legal basis, specific rules for identification and replacement, and performance evaluation. We should formulate and improve the legal basis for debt resolution measures and related fiscal policy tools at an appropriate time, promote the rule of law and marketization in debt identification and replacement, strengthen the performance evaluation of debt resolution measures, and improve relevant supporting measures with the reform of governmental investment and financing systems as the core.
