How to Unify Social Effects under Legal Effects: Correcting the Misunderstandings in Current Criminal Verdicts

摘要:

司法裁判如何实现法律效果与社会效果的统一,与裁判说理密切相关。将法律效果统一于社会效果的传统模式,在理论上不具备合法性,在实践上不具合理性,仅是将法律作为一种“包装术”;只有将社会效果统一于法律效果,才是正确的统一模式。在规则构建上,应通过体系归置与体系检验,将社会效果转化为刑法体系内的法律效果。体系归置是从社会效果到大前提的过程,属于法律发现,它让社会效果进入刑法体系,其法理依据在于社会效果与个案正义的关联;体系检验则是从大前提到法律效果的过程,属于法律适用,它让社会效果转化为法律效果,其法理依据在于罪刑法定与个案正义的统一性。在具体适用上,应通过法教义学的方法来开展上述步骤,法教义学不是简单地比对涵摄,也不是概念堆砌式的伪教义学,而是按体系思维进行论证说理。法教义学化并非易事,却是实现法律效果与社会效果统一的正确途径

Abstract:

The unity of legal and social effects in criminal judgments is closely tied to the reasoning behind the verdict. The traditional model of unifying legal effects under social effects lacks legitimacy in theory and rationality in practice; instead, unifying social effects under legal effects is the correct approach. In terms of rule construction, social effects should be transformed into legal effects within the criminal law system, involving two steps: systematic categorization and systematic verification. Systematic categorization is the process of moving from social effects to the major premise, belonging to legal discovery. It allows social effects to enter the criminal law system, grounded in the connection between social effects and individual justice. Systematic verification, on the other hand, is the process of moving from the major premise to legal effects, belonging to legal application. It transforms social effects into legal effects, grounded in the unity of legality and individual justice. In specific applications, social effects should be treated through legal dogmatics, which is not simply a comparison or a pseudo-dogmatics based on concept stacking, but rather an argumentation based on systematic thinking.
