摘要:

“推进机构、职能、权限、程序、责任法定化”可从两个层面来理解:一是通过立法使这五个方面在法律上得到具体明确的规定,使其有法可依。二是使这五个方面遵循法定原则,实施相关行为必须于法有据。以上两个层面,最需强调的是第二个,它把行政法定原则提升到了前所未有的广度,建构了行政法定原则的完整体系。这五个方面所具有的含义和面临的问题不尽相同,需在法定范围和法定程度方面加强理论研究,在盘点既有立法的基础上,明确重点难点,统筹谋划,以试验立法为路径,有序推进。

Abstract:

“Promoting the legalization of institutions, functions, authorities, procedures, and responsibilities”(referred to as“Five Legalizations”) can be understood from two levels: First, through legislation, the five aspects are specifically and clearly stipulated in law to ensure that there are laws to abide by. The second is to make the five aspects follow the statutory principles, and the implementation of related actions must be based on the law. Of the two levels, the second one needs to be emphasized most. It raises the administrative statutory principle to an unprecedented extent and constructs a complete system of administrative statutory principles. The meanings and problems faced by the“five legalizations” in five aspects are not the same,so it is necessary to strengthen theoretical research in the scope and degree of legalization.
