摘要:

不确定状态下如何认真对待权利与法治,无疑是我们每个人应认真思考的时代课题。作为公权力,其发布的法令或采取的措施,只有遵循合法原则与比例原则,才能合乎合法行政与合理行政的法治要求。重申“认真对待权利”之目的在于,权利作为法律的本质与目的,它既构成了法律的道德基础,亦构成了人们对法律尊重与忠诚的基石,进而成为政治道德的来源。通过重申“认真对待权利”这一经典命题,有助于社会公众对权利保障、法律信任、法治信仰以及政府公信力获得持续有效的普遍认同并达致共识。只有公权力认真对待并善待权利,方能体现其理性的政治道德;只有公权力公平对待社会每一个个体的权利,法律才能获得人们对它的接受与尊重,进而使人们相信法律、尊崇法律、信仰法治,维护政府的公信力。

Abstract:

How to treat rights and laws seriously in the uncertain state is undoubtedly the subject of the times for everyone to think seriously. As a public power, it can comply with the legal requirements of legitimate administration and reasonable administration only by following the principle of legality and proportion. Rights is the essence and purpose of law. The purpose of taking rights seriously is that it not only constitute the moral basis of law, but also constitute the cornerstone of people’s respect and loyalty to law. Furthermore, it is the source of political morality. By reiterating the classic proposition of“taking rights seriously”, the public will gain sustained and effective universal recognition and consensus on rights protection, legal trust, belief in the rule of law and government credibility. Only when the public authority treats the right seriously and treats the right well, can it embody its rational political morality. Only when the public power treats every individual in the society fairly, can the law be accepted and respected by people, and then make people believe in the law, respect the law, believe in the rule of law, and maintain the credibility of the government.
