Legitimacy and Optimality: The Basic Compliance of Administrative Punishment in the Supervision of Off Campus Training

摘要:

法治化是校外培训监管行政执法的应有之义,行政处罚作为典型的侵益性执法行为,能够集中反映、评价“双减”过程中执法法治化的程度。通过选取行政处罚作为透视“双减”执法的窗口, 采用合法性与最佳性的二维视角,可以发现校外培训行政处罚存在规范性欠缺、执法效能不高的双重困境。为此,应当在合法性考量和最佳性考量互动循环的基础上,以“依据—行为—程序”为逻辑,完善校外培训行政处罚规范体系,严格校外培训处罚裁量基准,深化行政处罚体制机制改革,探索教育行政处罚的法治化路径。

Abstract:

Rule of law is the right way for administrative law enforcement of off campus training regulation. As a typical benefit-distorted behavior, administrative penalties can reflect and evaluate the degree of rule of law enforcement in the process of“double reduction”. In this paper, administrative penalties are used as a window into the administrative law enforcement of the“double reduction”, and a two-dimensional perspective of legitimacy and optimality is adopted to find that the system of administrative penalties for off campus training suffers from a dual dilemma of lack of normativity and ineffective enforcement. In this regard, based on the interactive cycle of legitimacy and optimality, the logic of basis-act-procedure should be used to improve the legislative system of administrative penalties for off campus training, to strengthen the benchmarks for discretionary of administrative penalties for off campus training, to deepen the reform of the institutional mechanism of administrative penalties, and to build a rule of law path for administrative penalties in education.
