摘要:

平台信用评分机制建构了一个新型的评分社会,用户通过持有数字人格生活其中。这种分布式评分在平台规则与政府治理的双重需求下逐渐集中化,与征信体系、社会信用体系产生了双向度的联系,促成了现实生活与虚拟生活的相互嵌入与彼此塑造。平台信用评分机制对法治模式与社会信任模式产生了颠覆性的影响,可能形成无需法律的秩序与无需强制力的执行。这种以降低交易成本为初衷,试图建构信任的自我规制机制,逐渐催生出新型的权力结构,并产生了非标化与不当联结、独立性缺失与歧视强化、未知情同意与退出困难、价值层面的不平等与错配等一系列风险。平台信用评分需要走上法治化的规制路径,要确立政府监管与平台自治彼此交融、增量赋权的理念,促进数据分享与控制的平衡,对评分算法进行有效治理,探索出程序化、法治化的评分模式。

Abstract:

The platform ranking mechanism essentially constructs a new ranking society, in which users hold digital identification to live. Under the dual requirements of platform rules and government governance, this distributed scoring system is gradually centralized, and has a bidirectional relationship with credit system and social credit system, thus forms the mutual embeddedness and shaping of real life and virtual life. The platform ranking mechanism has a substantial impact on the existing legal pattern and trust system, which may form the“order without law”and “execution without force”. This kind of self-regulation mechanism, which aims to reduce the transaction cost and foster credit, gradually gives birth to a new power structure, and also produces a series of regulatory risks such as non-standardization and improper connection, lack of independence and reinforcement of discrimination, consent without knowledge and exit difficulty and exiting difficulties,inequality and mismatch in value. Therefore, it is necessary to systematically legalize the path of the platform ranking mechanism as follows: firstly, establishes the concept of blending government supervision with platform autonomy and increasing empowerment; secondly, promotes the balance between data sharing and control; thirdly, governs the scoring algorithm effectively, and finally explores a procedural and legalized scoring model.
