Open Source Licensing Agreements: An Alternative Institutional Arrangement for the Protection of AI-Generated Works

摘要: 开源正在重新定义21 世纪的计算基础设施。开源既是一种软件开发模式,也是一种版权保护模式,二者相辅相成,共同定义了开源运动。开源软件以附开源许可协议的模式来规定和明确开源软件权利人与使用者之间的权利与义务关系。开源许可协议的法律约束力源自著作权法,但是以合同作为例外,既保持了作者对作品必要的控制,又赋予使用者在一定条件下自由使用作品的权利,实质上创造了一个“受监管的公有领域”。开 源许可协议不仅具有行业性的道德约束力,同时也有司法层面的约束力。开源许可协议对于维护开源社区的良性、有序发展至关重要,同时其背后的规制理念可以为开发适用于 AIGC 作品的新型权利提供有益参考,已形成的开源规制体系也可直接用于 AIGC 作品的保护。

Abstract: Open source is redefining the computing infrastructure of the 21st century. Open source serves as both a software development model and a copyright protection model, with the two complementing each other to collectively define the open source movement. Open source software utilizes open source licensing agreements to stipulate and clarify the rights and obligations between the rights holders of open source software and the users. The legal binding force of open source licensing agreements originates from copyright law, but with contracts as an exception, they maintain necessary control for authors over their works while granting users the right to freely use the works under certain conditions, essentially creating a “regulated public domain”. Open source licensing agreements not only possess industry-specific moral binding force but also have binding force at the judicial level. These agreements are crucial for maintaining the healthy and orderly development of open source communities. Moreover, the underlying regulatory concepts can provide valuable references for developing new rights applicable to AIGC works, and the established open source regulatory system can also be directly applied to the protection of AIGC works.
